Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CommentMonster website (commentmonster.tech) and product (app.commentmonster.tech), operated by Comment Monster Inc.(“we,” “us,” “our”). By creating an account, signing in, or otherwise using CommentMonster, you agree to be bound by these Terms.
1. The service
CommentMonster is a software-as-a-service product that, after you connect your YouTube channel, Facebook Page, Instagram Business account, TikTok, or X account, uses third-party AI to draft replies to comments left on your channels and posts those replies on your behalf once you (or auto-mode, if enabled) approve them. The service is delivered through your account at https://app.commentmonster.tech.
2. Eligibility and account registration
You must be at least 16 years old and capable of forming a binding contract to use CommentMonster. You agree to provide accurate, current information when you sign up and to keep it accurate. You are responsible for safeguarding your password and any tokens or credentials we issue, and for all activity that occurs under your account. Notify us promptly at hello@commentmonster.tech if you suspect unauthorized access.
3. Free trial, subscriptions, and billing
New accounts receive a 7-day free trial with full feature access. No credit card is required at sign-up. After the trial ends, you may select a paid plan (Starter, Growth, Pro, or Monster) via your billing settings; payment is processed by Stripe.
Paid plans renew automatically (monthly or annually, as selected) until you cancel. You may cancel from your billing settings; monthly plans cancel at the end of the current billing cycle, and annual plans qualify for a prorated refund if cancelled within the first 30 days. Pricing displayed on the website may change, but increases will not apply to your current billing cycle.
Per-tier reply caps, channel limits, and team-seat limits are published on our pricing page. Going over a cap may pause replies until the next billing cycle or until you upgrade.
4. Your channels, content, and responsibility
You retain all rights to the channels, Pages, accounts, comments, replies, and other content you connect to or generate through CommentMonster. You represent and warrant that:
- You own or have explicit authorisation from the owner to connect each YouTube channel, Facebook Page, Instagram Business account, TikTok account, and X account you link to your CommentMonster account.
- The replies posted under your identity through CommentMonstercomply with all applicable laws and with the platforms’ terms of service (YouTube’s Community Guidelines and Spam Policy, Meta’s Community Standards, Platform Terms, and Developer Policies, TikTok’s Community Guidelines, and X’s Rules).
- You will not use CommentMonster to post deceptive content, impersonate others, manipulate engagement metrics in violation of platform rules, spam, harass, or harm any individual or community.
You are the publisher of every reply we post on your behalf. We provide the drafting and posting infrastructure; you control auto-mode toggles, review queues, and per-channel pauses, and you remain responsible for the content posted under your identity.
5. AI-generated content
Reply drafts are generated by third-party large language models. AI output may contain inaccuracies, omissions, hallucinations, or unintentionally inappropriate phrasing. Human-review mode is enabled by default precisely to let you catch these before publication. Auto-mode is opt-in per channel, layered with classification gates (spam, hate, low-confidence) and posting rate caps. You agree to review CommentMonster’s output for accuracy and appropriateness before relying on it, and to use auto-mode only after you trust the voice the AI produces for your channel.
6. Acceptable use
You agree not to:
- Use CommentMonsterto violate any law or third-party right or to violate any platform’s terms of service.
- Reverse-engineer, decompile, scrape, or attempt to extract source code or proprietary models from the service.
- Bypass, disable, or interfere with security, rate-limiting, anti-abuse, or quota-enforcement features.
- Resell, sublicense, or provide the service to third parties without our written agreement (white-label arrangements are available on the Monster plan).
- Submit false or misleading information (including third-party email addresses you do not control, or channels you do not own or manage).
- Use CommentMonster to generate content that is unlawful, defamatory, harassing, hateful, fraudulent, or sexually explicit, or that infringes intellectual-property rights.
We may suspend or terminate accounts that violate these rules.
7. Third-party platforms
CommentMonster integrates with YouTube, Facebook, Instagram, TikTok, and X via their public APIs and OAuth flows. Your use of those platforms remains subject to their own terms (YouTube Terms of Service, Meta Terms of Service, Meta Platform Terms, TikTok Terms of Service, X Terms of Service). Each platform may change its API, scopes, or policies at any time; we will adapt as quickly as we can, but we cannot guarantee uninterrupted access where a platform-side change makes that impossible.
8. Intellectual property
The CommentMonster name, logo, website, software, models, and documentation are owned by Comment Monster Inc. and protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the service in accordance with these Terms for the duration of your subscription.
9. Termination
You may terminate your account at any time from Settings → Danger zone → Delete account. Termination triggers a 30-day grace period during which logging back in cancels the deletion; after day 30, your account, connected channels, comments, drafts, voice profiles, and other personal data are permanently purged (see our data deletion page).
We may suspend or terminate your account if you violate these Terms, if your payment fails after a reasonable cure period, or if continued operation poses a legal, security, or platform-policy risk. Sections 4, 5, 6, 8, 10, 11, 12, and 14 survive termination.
10. Disclaimers
CommentMonsteris provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure; that AI-generated drafts will be accurate or appropriate; or that any specific outcome (engagement growth, subscriber growth, algorithmic reach, revenue) will result from use of the service.
11. Limitation of liability
To the maximum extent permitted by law, Comment Monster Inc. (and its officers, directors, employees, and agents) shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, business interruption, or harm to reputation, arising from or related to your use of the service, even if we have been advised of the possibility. Our aggregate liability for any claim arising out of or related to the service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $100.
12. Indemnification
You agree to indemnify and hold harmless Comment Monster Inc. and its affiliates from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from (i) your use of the service, (ii) replies or other content posted on your behalf, (iii) your violation of these Terms or any applicable law, or (iv) your violation of any third-party right or platform policy.
13. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the current version. Material changes will be notified by email or in-product banner. Continued use of the service after an update constitutes acceptance of the revised Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws principles. The parties agree to the exclusive jurisdiction of the state and federal courts located in the State of New York, USA for any dispute that is not resolved informally.
